Go Driver App: Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you, the driver ("Driver," "you," or "your"), and [Your Company Name], the developer and operator of the Go Driver mobile application ("App").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you may not use the App.

Please read these Terms carefully before using the App.

1. Acceptance of Terms

  • 1.1. By registering for and using the Go Driver App, you confirm your acceptance of these Terms and any future amendments or modifications to them.
  • 1.2. These Terms may be updated from time to time. We will notify you of any material changes via in-app notification, email, or by posting the updated Terms within the App. Your continued use of the App after such notification constitutes your acceptance of the revised Terms.

2. Eligibility

  • 2.1. To use the Go Driver App, you must be at least 18 years of age (or the legal age of majority in your jurisdiction).
  • 2.2. You must possess a valid driver's license, vehicle registration, vehicle insurance, and any other permits or licenses required by law in your operating jurisdiction to provide car-hailing services.
  • 2.3. You must maintain a clean driving record and pass any background checks or vetting processes required byENE TECH COMPANY LIMITED
  • 2.4. You represent and warrant that all information you provide to ENE TECH COMPANY LIMITED is true, accurate, current, and complete.

3. Driver Account and Security

  • 3.1. You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.
  • 3.2. You agree to notify ENE TECH COMPANY LIMITED immediately of any unauthorized use of your account or any other breach of security.
  • 3.3. ENE TECH COMPANY LIMITED will not be liable for any loss or damage arising from your failure to comply with this section.
  • 3.4. You may not share your account with any other person.

4. Use of the App

  • 4.1. License: Subject to your compliance with these Terms, ENE TECH COMPANY LIMITED grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Go Driver App on your personal mobile device solely for the purpose of offering car-hailing services to riders.
  • 4.2. Restrictions: You agree not to:
    • a. Use the App for any unlawful purpose or in any way that violates these Terms.
    • b. Impersonate any person or entity.
    • c. Interfere with or disrupt the integrity or performance of the App or its related services.
    • d. Attempt to gain unauthorized access to the App or its related systems or networks.
    • e. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
    • f. Use the App to transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
    • g. Engage in any activity that is abusive, harassing, threatening, defamatory, obscene, or otherwise objectionable.
    • h. Accept or solicit payments outside the App's payment processing system.
  • 4.3. Geolocation: The App requires access to your device's location services to function effectively (e.g., matching you with riders, navigation, fare calculation). By using the App, you consent to the collection and use of your location data as described in our Privacy Policy.
  • 4.4. Connectivity: You are responsible for obtaining the data network access necessary to use the App. Your mobile network's data and messaging rates and fees may apply.

5. Driver Obligations and Conduct

  • 5.1. Professionalism: You agree to provide car-hailing services in a professional, courteous, and safe manner at all times.
  • 5.2. Vehicle Condition: You must maintain your vehicle in a clean, safe, and roadworthy condition, in compliance with all applicable laws and regulations.
  • 5.3. Compliance with Laws: You are solely responsible for compliance with all local, state, national, and international laws, rules, and regulations applicable to your provision of car-hailing services, including but not limited to traffic laws, transportation regulations, and tax obligations.
  • 5.4. Safety: Your primary responsibility is the safety of yourself and your riders. You must adhere to all traffic laws and exercise caution while driving.
  • 5.5. No Discrimination: You agree not to discriminate against any rider on the basis of race, color, religion, national origin, disability, sexual orientation, gender, marital status, or any other protected characteristic.
  • 5.6. App Usage: You agree to use the App as intended and not to manipulate the system (e.g., by accepting and immediately canceling rides without justification).

6. Mileage Subscriptions and Payments

  • 6.1. Subscription Model: Access to and use of the Go Driver App for accepting ride requests is contingent upon the purchase of a valid mileage subscription package ("Subscription Package").
  • 6.2. Subscription Packages: We offer various Subscription Packages, each providing a specific mileage allowance (e.g., 100 km, 500 km, unlimited for a period). Details of available Subscription Packages, including pricing, included mileage, duration, and any additional benefits, will be displayed within the App.
  • 6.3. No Commission: When operating under an active Subscription Package, ENE TECH COMPANY LIMITED will not deduct any commission from the fares you earn from riders for rides completed through the App. You retain 100% of the rider fare for such rides.
  • 6.4. Fare Calculation: Fares for rides will be calculated based on the App's algorithm, which may consider factors such as distance, time, demand, and any applicable tolls or surcharges. The full calculated fare for each ride will be directly payable to you, the Driver, through the App's payment processing system.
  • 6.5. Subscription Purchase and Renewal:
    • a. You can purchase Subscription Packages directly through the App using the available payment methods.
    • b. Subscriptions are non-refundable, except as expressly required by law.
    • c. It is your responsibility to monitor your remaining mileage and renew your Subscription Package as needed to continue receiving ride requests.
    • d. If your mileage runs out or your Subscription Package expires, you will not be able to accept new ride requests until a new Subscription Package is purchased.
  • 6.6. Payment Processing for Fares: Payments from riders will be processed through the App's designated payment system. ENE TECH COMPANY LIMITED will facilitate the transfer of 100% of your net earnings (after any rider-side transaction fees, if applicable and clearly disclosed) to your designated bank account on a schedule specified within the App (e.g., daily, weekly).
  • 6.7. Taxes: You are solely responsible for all taxes, duties, and levies arising from your earnings through the App, including but not limited to income tax and sales tax. ENE TECH COMPANY LIMITEDwill not provide tax advice. You are also responsible for any taxes associated with the purchase of your Subscription Package.
  • 6.8. Disputes: Any disputes regarding rider payments or Subscription Package purchases must be reported to ENE TECH COMPANY LIMITED support within [e.g., 48 hours] of the transaction or purchase.

7. Ratings and Feedback

  • 7.1. Riders will have the opportunity to rate and provide feedback on your services. These ratings are crucial for maintaining the quality of the Go Driver platform.
  • 7.2. ENE TECH COMPANY LIMITED reserves the right to suspend or terminate your access to the App if your average ratings fall below a certain threshold or if you receive significant negative feedback.

8. Intellectual Property

  • 8.1. The Go Driver App, including its software, content, design, and all intellectual property rights related thereto, are owned by or licensed to ENE TECH COMPANY LIMITED
  • 8.2. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you decompile or attempt to extract the source code of the App.

9. Privacy

  • 9.1. Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the App, you agree to the terms of our Privacy Policy.
  • 9.2. You acknowledge and agree that ENE TECH COMPANY LIMITED may share your information with third parties as necessary to provide the App's services, comply with legal obligations, or for legitimate business purposes.

10. Disclaimers and Limitation of Liability

  • 10.1. "AS IS" Basis: The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • 10.2. No Guarantee of Fares: ENE TECH COMPANY LIMITED does not guarantee any minimum number of ride requests or earnings to the Driver, nor does it guarantee that the mileage allowance within a Subscription Package will translate to a specific amount of earnings.
  • 10.3. Driver Responsibility: You acknowledge that you are solely responsible for your interactions with riders and for your driving activities.
  • 10.4. Limitation of Liability: To the fullest extent permitted by applicable law, ENE TECH COMPANY LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; or (c) unauthorized access, use, or alteration of your transmissions or content.
  • 10.5. Maximum Liability: In no event shall the aggregate liability of ENE TECH COMPANY LIMITED exceed the greater of (a) the amount paid by you to ENE TECH COMPANY LIMITED in the six (6) months immediately preceding the event giving rise to the claim for Subscription Packages purchased, or (b) One Hundred US Dollars ($100).

11. Indemnification

  • 11.1. You agree to indemnify, defend, and hold harmless [Your Company Name], its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use of the App, your violation of these Terms, your violation of any rights of another (including riders), or your breach of any applicable laws or regulations.

12. Suspension and Termination

  • 12.1. ENE TECH COMPANY LIMITED may, in its sole discretion, suspend or terminate your access to the App, with or without notice, for any reason, including but not limited to:
    • a. Violation of these Terms.
    • b. Negative rider feedback or low ratings.
    • c. Safety concerns.
    • d. Fraudulent or illegal activity.
    • e. Non-compliance with applicable laws or regulations.
    • f. Non-payment for a Subscription Package.
  • 12.2. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

  • 13.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law principles.
  • 13.2. Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be settled by binding arbitration administered by [e.g., the American Arbitration Association, a local arbitration body] in accordance with its [e.g., Commercial Arbitration Rules]. The arbitration shall be conducted in [Your City, Your Country]. The decision of the arbitrator shall be final and binding upon the parties.

To the full extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

14. General Provisions

  • 14.1. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ENE TECH COMPANY LIMITED regarding the use of the App.
  • 14.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
  • 14.3. Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and ENE TECH COMPANY LIMITED's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
  • 14.4. Assignment: You may not assign or transfer your rights or obligations under these Terms without the prior written consent of ENE TECH COMPANY LIMITED ENE TECH COMPANY LIMITED may assign its rights and obligations under these Terms without restriction.
  • 14.5. Force Majeure: ENE TECH COMPANY LIMITED shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
